España y China firman un convenio bilateral de Seguridad Social para evitar la doble cotización

La ministra de Empleo y Seguridad Social, Fátima Báñez, y el ministro de Recursos Humanos y Seguridad Social de China, Yin Weimin, firmaron la pasada semana el convenio y acuerdo administrativo de Seguridad Social para evitar la doble cotización durante la reunión de los ministros de Empleo del G20 en Bad Neunahr (Alemania).

El Consejo de Ministros aprobó el convenio bilateral en materia de Seguridad Social entre España y China para garantizar la protección social de los trabajadores desplazados y para evitar la doble cotización a la Seguridad Social.

Las negociaciones entre España y China se iniciaron en 2011, tras dos rondas de reuniones que tuvieron lugar en Madrid y Pekín y que han concluido con la firma del texto que han suscrito los responsables de Empleo y Seguridad Social de los dos países.

El objetivo de este convenio es reducir los costes sociales que tienen que soportar las empresas con trabajadores desplazados de uno u otro país. Además, establece un plazo inicial de seis años en el que los trabajadores españoles desplazados por su empresa a una delegación en China estarán asegurados por el sistema español.

Durante este periodo, las cotizaciones por prestaciones de jubilación, incapacidad permanente, muerte y supervivencia y desempleo se realizarán al organismo español. Por ello, quedarán exentos de cotizar al seguro básico de vejez para trabajadores por cuenta ajena y al seguro de desempleo de China. Sin embargo, las cuotas por asistencia sanitaria, incapacidad temporal y por accidente de trabajo y enfermedad profesional se realizarán a la administración china.

Asimismo, las cotizaciones por los trabajadores chinos desplazados a España se realizarán a la Seguridad Social española por las prestaciones del régimen general durante el mismo periodo de tiempo que en los casos anteriores.

No obstante, las cuotas por pensiones derivadas de contingencias comunes o por accidente laboral y desempleo se realizarán al organismo chino.
